48 HOURS on CBS. Did you watch last night's episode called, "Playing by the rules?." Boy, what a tough case, but David Temple won his hearing to possibly get a new trial. It is now up to the Texas court of appeals. It all boiled down to whether a prosecuting attorney withheld evidence during David's 2007 murder trial. He was convicted of killing his wife Belinda & their unborn child back in 1999. He got a life sentence in prison.
Kelly Siegler defended her job as prosecutor during that trial & says the defense got all the evidence they deserved under Texas law. A 16-year-old male stole his dad's shotgun which is similar to the gun that killed Belinda. The murder weapon was never found & so it wasn't entered in as evidence. That young male was never looked at as a suspect even though he co-operated with police & took the witness stand.
Everybody is angry at Kelly Siegler who still thinks David killed his wife to be with a beautiful blonde teacher. There are former high school students of David who also think he belongs in prison. His new defense lawyers are taking it very personal & blame Siegler who is no longer a prosecutor. David's case was very circumstantial because there is no evidence putting him at the crime scene. There is also no evidence putting that 16-year-old at the crime scene either. 12 jurors believed that David killed his wife back in 2007. The Texas court of appeals can make a decision at any time on David's case.

I remember seeing this report when it first aired and it was obvious the over zealous prosecutor would do anything within her power to prove he was guilty. It doesn't surprise me at all to find out that she withheld evidence that would have proved his innocence.
